【TSV-Viewer Trial Version: Terms of Use】

Article 1: Terms of use of this service
(1) Based on the terms of use of this service, TechnoStar Co.,Ltd. （"first party"） provides the TSV-Viewer Trial Version ("this service") to the Users ("second party") in the form of a Java Server Page ("JSP") using ActiveX technology. The second party uses this sevice via the internet based on the terms of use of this service.
(2) The terms of use of this service applies to all issues regarding the provision of this service from the first party to the second party, and the use of this service by the second party.
Article 2: Range of the terms of use of this service
(1) If the first party defines any of the following additional terms to the terms of use of this service ("additional terms and conditions"), they will be considered as a part of the terms of use of this service and will be applied to the use of services by the second party. (Hereinafter, "additional terms and conditions" are considered to be included in the phrase "terms of use of this service".)
　1.Any rule regarding this service that is notified within this service, regardless of its naming, for example "Additional terms and conditions", "Notes", "Information" etc.
　2.Other than the previous term, any notification that is made within this service regarding the qualifications or rights of the second party, the use of this service, or others.
(2) Unless otherwise specified, the additional terms and conditions described previously become effective from the moment the first party expresses them within this service, and it is assumed that the second party has agreed to them.
(3) In case the content of the terms of use of this service contradicts that of the additional terms and conditions, the content of additional terms and conditions supersedes that of the terms of use of this service.
Article 3: Changing the terms of use of this service
(1) The terms of use of this service is subject to being added or changed without prior notice or consent of the second party.
(2) Unless otherwise specified, the addditions and changes that are made to the terms of use of this service become effective from the moment the first party expresses them within this service, and it is assumed that the second party has agreed to them.
Article 4: Users
(1) The term "user" refers to the person who has agreed to the terms of use of this service and has started using the TSV-Viewer Trial Version, and the terms of use of this service ("terms of use") are considered to be completed and concluded between the first and second party.
(2) Users of this service must agree to the terms of use of this service before using this service. Once the user has started to use this service, it is assumed that he/she has agreed to the terms of use of this service.
Article 5: Contents of this service
(1) This service which the first party provides to the second party is displayed in the web site of the first party under the menu named "TSV-Viewer ～Trial Version～", and the content of the service is limited to what is reasonably providable by this service.
(2) This service is subject to being added, changed or terminated without prior consent of the second party.
Article 6: Provision of this service
The first party will attemp to operate the system related to this service ("operation system") 7 days a week, 24 hours a day, and make this service available to the second party, except for cases specified in article 9.
Article 7: User support for this service
(1) The second party are requested to send questions that are related to the operation or use of this service by email, and the first party will receive these questions on their business days.
(2) After the first party receives questions from the second party, the first party will respond on the following business day or after.
(3) Considering that this service is provided free of charge, the first party will not provide support to the second party in any form other than specified above (such as visits).
Article 8: Compensation
This service is provided free of charge.
Article 9: Termination of the operation system
(1) In cases specified below, the first party can shut down the operation system of this service or disconnect the communication line and terminate the provision of this service.
　1.When inspection, maintenance, or construction of the operation system is necessary.
　2.When unavoidable due to system failure, etc.
　3.When services from the telecommunication corporation that the first party uses are terminated.
(2) Considering that this service is provided free of charge, the first party will not be liable for any damages caused by the termination of this service.
Article 10: Measures taken when problems occur
(1) When a problem that prevents the normal use of this service is detected, the first party will promptly notify the second party and determine the cause of the problem.
(2) When the cause of the problem is attributable to the first party or its operation system, the first party will promptly take necessary measures.
(3) When the cause of the problem is attributable to the second party or its environment, the first party will provide necessary support measures to the second party.
(4) In cases specified in articles 10.2 or 10.3, the first and second parties will copperate sincerely to the other party when requested.
Article 11: Responsibility
Considering that this service is provided free of charge, the first party will not be liable for any damages caused by this service, regardless of the cause or reason.
Article 12: Guarantees
The first party does not provide any guarantees to the second party for the usability of this service for any particular purpose or any particular effect.
Article 13: Relation of rights
Upon use of this service by the second party, no rights of the operation system such as copyrights will be transferred to the second party.
Article 14: Compensation for loss
(1) Considering that this service is provided free of charge, the first party will not be liable for any damages caused by this service, regardless of the cause or reason.
(2) In case the second party causes damage to the first party, the second party is liable for these damages.
Article 15: Entire agreement
The terms of use of this service represents the entire agreement between the first and second parties as of the day of agreement, and supersedes any other agreement or understanding, provided material or offers that the parties heretofore may have had. The first and second parties are not entitled to or liable to any rights or obligations that are not specified in the terms of use of this service.
Article 16: Court of jurisdiction
Regarding lawsuits related the provision, use, or terms of use of this service, the first and second parties agree that the Tokyo District Court will be the exclusive court of first instance.
Article 17: Sincere consultation
Any matters that are not stipulated herein shall be settled upon sincere consultation between both parties.
